PURPOSE OF THE SITE

The purpose of the Site is to provide Technical Information for repairing and servicing Company’ Products to subjects who have rights to this in accordance with Article 53(1) of Regulation (EU) No 167/2013 of the European Parliament and of the Council. . This access is made available as indicated in and required by Commission Delegated Regulation (EU) No 1322/2014 of 19 September 2014for Technical Information regarding agricultural and forestry vehicles. For all details of or any specific exceptions to the above-mentioned regulations, please consult the Terms and Conditions section of this Site as per above.

ACCESS TO TECHNICAL INFORMATION

It is possible to verify the types and characteristics of the available Technical Information by registering for and accessing the Site. After checking for the required Technical Information, it is possible to consult this by purchasing subscriptions to packets of timed access on an annual, monthly, weekly, daily and hourly basis. These packets are also divided according to Technical Information type. For all details regarding access to the Technical Information, please consult the Terms and Conditions section of this Site.

COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS

The Company is the sole holder of the exclusive rights granted by the regulations on copyright and industrial property rights, respectively, on the form and content of the Technical Information, regulated by the terms for access to the Technical Information the Customer signed at the time of purchase. Moreover, unless there are specific indications to the contrary, any trademark, logo, picture, drawing, sound, music, film, video, software or anything else on the Site (hereinafter referred to as "Objects") are covered by relevant rights protecting ownership of the same such as, by way of example but not exhaustively, trademark rights, patent rights, copyright, etc. These rights are all lawfully held by the Company or are used under license by the Company with a concession from the owners. Therefore, any use (copying, partial copying, hardcopying) of the Objects is forbidden, except for strictly personal use. Strictly personal use is understood to mean saving a copy on your personal computer or printing the Objects to keep as documentation for personal use. Therefore, the distribution and transmission - including publishing on other web sites - to third parties of the Objects, the modification, republication, re-use with the inclusion in other documents or files, and any type of reprocessing of the same is considered not strictly personal use - and as such unlawful. The Company is in no way responsible for, nor can it be held responsible for violations of the rights that the owners of the Objects have granted in concession to the Company in cases when said owners claim Site users have in some way violated these rights. The Site user who commits the violation is the sole responsibility for said violation.

DAMAGES PURSUANT TO CONNECTIONS

Neither the Company nor any other companies controlled, directly or indirectly, by CNH Industrial NV,shall be liable for damages pursuant to access and registration on the Site and the use and/or downloading of Objects contained therein, whether such damages are caused by faults, errors, or anything else, or the consequent inability to use the Site material.

The Company protects privacy, both in accordance with the law and as Company policy. PROVISION OF PERSONAL DATA

If a Site visitor intends to voluntarily provide their data defined as personal by the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and any applicable local privacy law,  this can only be done by following the rules and procedures on the Site in accordance with the aforementioned  privacy laws. Personal data is provided by every Site visitor as a free choice. The Site does not record any personal data except after having clearly and specifically informed the visitor of the possibility of registering their personal data. In order to avoid mistakes or misunderstandings, no personal data can be registered without further and final confirmation by the visitor. 

BROWSING THE SITE AND ACCESS REGISTRATION - COOKIES AND LOG FILES

The Company uses cookie technology to gather statistical information on the Site. A cookie is a small informative element sent by the Web site contacted and saved on the hard disk of your computer by the browser. The Site traces the path of the cookie (an activity known as "click stream" i.e. it records the paths used by site visitors from one page to the next) although this activity does not make it possible to identify the user who is browsing the site, to collect statistical data on the site such as, for example, the pages opened, pages downloaded, etc. We reiterate that none of this information is associated with you individually. Cookies do not contain your e-mail address or any other private information. The information obtained from tracking cookies is evaluated as a whole. The Company also uses the web server's log files to count the number of visitors and evaluate the technical capabilities of our site. We use this information in order to obtain data on site usage, and organize the pages in the most accessible manner possible, to make site navigation easier with more useful information in the pages. We collect information on site traffic, but not on individual visitors. As a consequence, no personal information will be kept or used. The Company shall make this information available to the relevant authorities only when necessary, in the case of fraudulent use.

If you wish to send an e-mail to the Site for any reason, or the Site invites you to subscribe to a mailing list to receive information on your computer, we repeat that, if any of these possibilities requires the registration of your personal information, this will always be done in compliance with the Privacy Act. APPLICABLE LAW - PLACE OF JURISDICTION

As indicated in the warnings, access to the Site entails full acceptance of the Site rules. Accordingly, the user who gains access to the Site agrees that the applicable law and the competent Court shall be the ones where the Company has its registered office.
